What is Business Rescue in South Africa?

In South Africa, formal business rescue is governed by Chapter 6 of the Companies Act 71 of 2008. It temporarily suspends legal action against a distressed company while a rescue plan is developed and implemented.

However, formal proceedings are not always necessary or appropriate — particularly for smaller businesses. In many cases, an experienced financial advisor working directly with the business, its creditors, and SARS can develop a practical rescue plan without formal proceedings.
